Terms of Service

These Terms of Service (the "Terms") govern your use of HeiHa AI Media Maker (the "Service"). By installing, accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country, whichever is higher) to use HeiHa. By using the Service you represent and warrant that you meet this requirement and that you are not barred from using the Service under applicable law.

2. Your Account

You are responsible for the activity on your account and for keeping your credentials secure. You must provide accurate information and promptly update it if it changes. We may suspend or terminate an account that violates these Terms.

3. Acceptable Use

You agree not to use HeiHa to create, upload, generate or share content that:

• sexually exploits or endangers minors in any form;
• depicts a real identifiable person without their consent, including "deepfakes" and non-consensual intimate imagery;
• infringes intellectual property or publicity rights of others;
• promotes hatred, harassment, violence, or illegal activity;
• is designed to deceive, impersonate or commit fraud;
• interferes with the Service, including through scraping, reverse engineering, or automated abuse.

4. Your Content & Generated Output

You retain all rights to the prompts and reference media you submit ("Your Content"). You grant HeiHa a worldwide, non-exclusive, royalty-free licence to host, process and transmit Your Content solely to operate the Service and deliver the outputs you request. As between you and HeiHa, you own the outputs you generate, subject to third-party rights and these Terms. You are responsible for ensuring your use of any output complies with applicable law.

5. Subscriptions, Credits & Refunds

HeiHa offers a free tier with limited credits and paid subscriptions with additional credits and features. Subscriptions are billed through Apple App Store or Google Play and auto-renew until cancelled. Credits are non-refundable once consumed. Refund requests are handled by the applicable app store under their standard policy.

6. Intellectual Property

HeiHa, our logos, designs and underlying software are protected by intellectual property laws. Except for the limited licence to use the Service granted in these Terms, no rights are transferred to you.

7. Copyright Complaints

If you believe content on HeiHa infringes your copyright, please send a notice to the contact below including: the work you claim is infringed; the material you want removed and where it is; your contact information; a statement of good-faith belief; and a statement under penalty of perjury that you are authorised to act.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably believe termination is needed to protect HeiHa or other users. Some clauses survive termination, including sections on content licence, disclaimers, liability and governing law.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. AI-generated output may be inaccurate, unexpected, or resemble existing works — review it before relying on it or publishing it.

10. Limitation of Liability

To the fullest extent permitted by law, HeiHa will not be liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our aggregate liability will not exceed the greater of (a) amounts you paid to HeiHa in the twelve months before the event giving rise to liability, or (b) USD 100.

11. Governing Law

These Terms are governed by the laws of the People's Republic of China (China mainland), without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of Tianjin, unless local mandatory law provides otherwise.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes we will notify you in the app or by updating the effective date above. Your continued use after an update constitutes acceptance of the revised Terms.
